AI tools such as ChatGPT, Microsoft Copilot, Google Gemini and Claude have made it easier than ever to create documents in seconds. Need an employment agreement, workplace policy, performance letter or job description? Enter a prompt and AI can produce something that looks polished and professional almost instantly.

But when it comes to HR documents, looking right and being right are two very different things.

Employment documents can create legal obligations, establish workplace expectations and influence how employment issues are handled later. An AI-generated document may sound convincing while containing outdated information, inappropriate clauses or wording that simply does not work for your business or the situation you are dealing with.

Key takeaway: AI does not know your workplace, your people or the full context behind the document you are asking it to create.

Why using AI for HR documents can be risky

Generative AI predicts what a useful response should look like based on the information available to it and the instructions you provide.

It does not replace the judgement of an experienced HR professional.

That distinction becomes particularly important when creating documents such as:

  • Employment agreements
  • Workplace policies
  • Offer letters
  • Performance management documentation
  • Disciplinary letters
  • Restructuring communications
  • Job descriptions
  • Flexible working agreements
  • Contractor documentation
  • Employee handbooks

A mistake in a marketing draft can usually be edited. A mistake in an employment document may have much more significant consequences.

1. AI can give you an answer that sounds right but isn’t

One of the biggest risks with generative AI is also what makes it so useful: it is very good at producing confident, well-structured answers.

The problem is that confidence is not the same as accuracy.

AI-generated HR documents can include clauses or statements that sound entirely reasonable but are incorrect, incomplete or unsuitable under New Zealand employment law.

That can be difficult to identify if the person using AI does not already know what the correct answer should be.

For example, New Zealand employers are required to provide employees with written employment agreements, and individual employment agreements must contain specific information. Remember: AI generating an employment agreement does not remove the employer’s responsibility to get those requirements right.

2. Employment law changes, but your AI-generated document may not

Employment law is not static.

  • Legislation changes.
  • Case law develops.
  • Government guidance changes.
  • What was appropriate in an employment agreement or workplace policy several years ago may no longer reflect current requirements or best practice.

Recent changes illustrate the problem particularly well. Changes to the Employment Relations Act that took effect in February 2026 affected areas including collective agreement requirements, contractor status, dismissal protections for certain high-income employees and personal grievance remedies. Employment New Zealand specifically advised employers that they may need to review employment agreement templates, hiring processes and workplace policies as a result.

Unless you know what the current requirements are, how do you know whether the document AI has produced reflects them?

3. A generic document may not protect your business

There is no single employment agreement or HR policy that is right for every workplace.

A construction company, professional services firm, retailer and technology business may all need very different provisions, even if they are hiring someone into a role with the same job title.

Your documents may need to consider issues such as:

  • Working hours and locations
  • Hybrid or remote working arrangements
  • Confidential information
  • Intellectual property
  • Use of company equipment
  • Availability requirements
  • Trial periods
  • Restraint of trade
  • Health and safety obligations
  • Workplace conduct
  • Role-specific responsibilities

Some clauses also require particular care. For example, restraint of trade provisions need to reflect the business’s actual needs, while working-from-home arrangements can raise additional questions around expectations, responsibilities and health and safety.

Example: If you ask an AI tool to “write an employment agreement for a sales manager in New Zealand”, it does not automatically understand how your sales team operates, what commercial information the employee will access, where they work, what risks exist in the role or what protections your business actually needs.

You can end up with a document that ticks boxes without solving the problem the document is supposed to address.

4. The quality of the document depends on the quality of your prompt

AI cannot ask all the questions an experienced HR professional knows need to be asked unless you specifically instruct it to do so.

This creates a knowledge gap.

If you already understand employment law and HR, you are more likely to know:

  • What information the AI needs
  • What clauses should be included
  • What questions need to be asked
  • Which parts of the output require checking
  • When something doesn’t look right

If you don’t have that expertise, you may not know what is missing.

The knowledge gap: AI can help you draft an answer, but it cannot reliably tell you which questions you should have asked in the first place.

5. HR documents rarely exist in isolation

An employment agreement is connected to your policies. Your policies are connected to your procedures. Your procedures affect how managers deal with employees.

Example: An employment agreement says one thing about working from home, an employee handbook says something different, and a manager has communicated a third arrangement.

Creating documents individually through AI can make it easy to accumulate a collection of templates without considering how they work together.

An experienced HR professional looks beyond the individual document and considers the wider employment relationship and the systems surrounding it.

6. AI does not understand the human context

This becomes even more important when AI is used for documents relating to an existing employee issue.

A disciplinary letter, performance improvement plan or restructuring communication is not simply a writing exercise.

The wording is the end result of a much bigger process:

  • What happened?
  • What conversations have already taken place?
  • What evidence exists?
  • Has the employee had an opportunity to respond?
  • What process has been followed?
  • Is the proposed action proportionate?
  • What needs to happen next?

AI can draft a professional-looking letter from the information it receives, but it cannot independently determine whether the process behind that letter has been fair or appropriate.

In employment relations, the document and the process behind it both matter.

7. You may be sharing sensitive information with an AI tool

There is another risk that is easy to overlook: the information being entered into the AI system.

HR documents can contain highly sensitive information about employees, including performance concerns, complaints, remuneration, personal circumstances and workplace investigations.

Copying identifiable employee information or confidential business information into an external AI platform without considering how that information is processed can create privacy and confidentiality risks.

Before using any AI platform for HR work, businesses should understand what information is being shared, whether it needs to be shared at all, and the organisation’s own privacy and AI-use requirements.

So, should businesses avoid AI for HR altogether?

Not necessarily.

AI can be extremely useful for brainstorming, summarising information, creating first drafts and improving the clarity of existing content.

The risk comes from treating AI output as HR advice rather than a drafting tool.

A useful rule: Use AI to help you work with HR information, not to replace the HR expertise required to make important employment decisions.

If the document affects someone’s employment, establishes contractual obligations, manages a workplace issue or could expose the business to risk, having an experienced person review the situation and the document can save considerably more time and cost later.

A document is only as good as the thinking behind it

The appeal of AI is understandable. It is fast, accessible and can produce an employment agreement or HR policy in seconds.

But speed is not the same as certainty.

The real value of good HR support isn’t simply having someone who can write a document. It is having someone who understands what needs to go into it, why it matters, what could go wrong and how the document fits into the wider employment relationship.
